3. Quotes and orders

Prices given through the quote form, by phone or by messaging app are not final until confirmation and issue of a proforma invoice or contract. Rates may change due to changes in carrier rates, port charges or exchange rates.

The terms of each order are set out in the relevant proforma invoice, contract or bill of lading, and in case of conflict those documents prevail over these terms.

4. User obligations

  • Provide accurate and complete information about the goods, their value, weight, dimensions, shipper and consignee
  • Provide the documents and permits required for shipping, import, export and customs clearance on time
  • Do not ship goods that are prohibited or restricted under the laws of the UAE, the countries of origin, transit and destination, or applicable sanctions and export-control rules
  • Pack the goods appropriately for the chosen mode of transport
  • Pay charges on time in accordance with the proforma invoice or contract

The user is responsible for the consequences of inaccurate or incomplete information, including fines, cargo holds and storage charges. Sivan Port may refuse, suspend or cancel a shipment that it believes breaches the law or sanctions, and the user bears the resulting costs.

5. Limitation of liability

Sivan Port performs the services with due care and in line with professional practice. The liability of carriers (shipping lines and airlines) is determined by the bill of lading or air waybill and by the applicable international conventions and national law.

Sivan Port is not liable for delay or loss caused by customs or other authorities, changes to carrier schedules, inaccurate user information or force majeure. We recommend cargo insurance to cover possible loss or damage in transit.

6. Force majeure

In events such as natural disasters, war, sanctions, strikes, port closures or government decisions beyond the control of the parties, obligations are suspended until the obstacle is removed, and neither party is liable for the resulting delay.
